The Final Contract (rogito)
The final transfer of the property takes place on the signing of the final deed or contract of sale.
Known as the rogito, this document is nonetheless likely to be titled under different names:
- Compravendita
- Atto di vendita
The contract will be signed in front of a notary (notaio) to formalise the transaction, either by the parties themselves or by their attorney if they have drawn up a power of attorney (procura).
The final deed of sale largely replicates the same contents found in the compromesso but will also provide the particulars of the notary concerned and contain clauses on payment of the balance, handover of keys, etc.
It may also contain other appendices:
- floor plan (planimetria)
- energy performance certificate (attestato di prestazione energetica)
- service logbook (libretto di impianto)
Implications of the rogito.
As mentioned above, the signing of the rogito marks the formal completion of the property transfer.
It also marks the moment when taxes and stamp duties must be paid. Please read the relevant section on property transfer taxes.
Once all taxes have been paid, the property can be registered in your name and you become the legal owner of the property!
